Terms of Service

Agreement to Terms

By accessing or using mbuzz, you agree to be bound by these Terms of Service. If you're using mbuzz on behalf of a company, you represent that you have authority to bind that company to these terms.

mbuzz is operated by Forebrite Pty Ltd (ABN 64 671 038 958). When we say "mbuzz," "we," "us," or "our," we mean Forebrite Pty Ltd.

What mbuzz Does

mbuzz is a multi-touch attribution platform. We provide:

• APIs and SDKs to collect events from your website or application
• Attribution models to analyze your marketing touchpoints
• Dashboards to visualize your data
• Data export capabilities

Your Account

To use mbuzz, you must create an account with a valid email address and company name. You're responsible for:

• Keeping your login credentials secure
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized access

You must be at least 18 years old and legally able to enter into contracts to use mbuzz.

Billing and Payment

How Billing Works

mbuzz uses a prepaid base plan with metered overage model:

1. Base plan: You pay your monthly plan fee in advance at the start of each billing cycle
2. Included events: Your plan includes a set number of events per month (e.g., 50K for Starter)
3. Overage: If you exceed your limit, we automatically charge your card for additional 10K blocks

Overage Charges

When you exceed your plan's event limit:

• We charge your card immediately for one 10K block at your plan's overage rate
• Charges are in full 10K blocks (no partial blocks)
• Each additional 10K events triggers another charge
• You can track your usage in real-time on the dashboard

Current overage rates:

• Starter: $5.80 per 10K events
• Growth: $3.96 per 10K events
• Pro: $2.99 per 10K events

We send email notifications at 80% and 100% of your plan limit, and for each overage charge.

Free Tier

The Free tier includes up to 10,000 events per month. This is a hard cap:

• When you reach 10K events, we stop storing new events
• There are no overage charges on the Free tier (no payment method required)
• To continue tracking beyond 10K, you must upgrade to a paid plan
• Your event counter resets at the start of each monthly cycle

Payment Failures

If a payment fails (overage charge or plan renewal):

• Immediately: We stop storing new events
• Your existing data remains accessible (read-only)
• We retry the payment: after 24 hours, 72 hours, and 7 days
• We send email notifications for each retry attempt

Important: Events that occur during a payment failure are not stored and cannot be recovered. Once payment succeeds, event storage resumes, but lost events are gone permanently.

For plan renewals, we provide a 3-day grace period where events continue to be stored while we retry the payment.

Plan Changes

• Upgrades: Take effect immediately. You receive prorated credit for your current plan
• Downgrades: Take effect at the start of your next billing cycle
• Cancellation: Your plan remains active until the end of the current billing cycle. No prorated refunds

Refunds

We don't offer refunds for partial months or unused events. If you believe you were incorrectly charged, contact us.

Acceptable Use

You agree not to use mbuzz to:

• Violate any laws or regulations
• Track users without proper consent where required by law
• Collect sensitive personal data (health, financial, etc.) without appropriate safeguards
• Attempt to reverse-engineer, hack, or compromise our systems
• Resell mbuzz services without our written permission
• Send events designed to artificially inflate your usage or test our rate limits
• Use automated systems to circumvent usage limits

We reserve the right to suspend or terminate accounts that violate these terms.

Your Data

You own your data. We don't claim any ownership of the events, sessions, or visitor data you collect through mbuzz.

You can export your data at any time through the dashboard or API. If you cancel your account, you have 90 days to export your data before it's permanently deleted (see our Privacy Policy for details).

You're responsible for ensuring you have proper consent and legal basis to collect data from your users. mbuzz is the data processor; you are the data controller.

Intellectual Property

mbuzz and its original content, features, and functionality are owned by Forebrite Pty Ltd and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive license to use our APIs and SDKs for the purpose of sending events to mbuzz. You may not copy, modify, or distribute our code except as provided in our SDK documentation.

Service Availability

We strive for high availability but don't guarantee 100% uptime. We may occasionally:

• Perform maintenance (we'll try to notify you in advance)
• Experience unplanned outages
• Rate-limit or throttle requests to protect system stability

We don't offer formal SLAs at this time. For enterprise customers needing guaranteed uptime, contact us to discuss custom arrangements.

Limitation of Liability

To the maximum extent permitted by law:

• mbuzz is provided "as is" without warranties of any kind
• We're not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months before the claim
• We're not liable for data loss, including events not stored due to payment failures or service outages

Some jurisdictions don't allow these limitations, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless mbuzz and Forebrite Pty Ltd from any claims, damages, or expenses arising from:

• Your use of mbuzz
• Your violation of these terms
• Your violation of any third-party rights
• Data you collect through mbuzz

Termination

You can cancel your account at any time through the dashboard. Your service continues until the end of your billing cycle.

We can terminate your account if you:

• Violate these terms
• Fail to pay after all retry attempts
• Use mbuzz in a way that could harm us or other users

Upon termination, your data is handled according to our Privacy Policy (tracking data deleted immediately, account data retained for 90 days).

Disputes

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

Before filing a formal dispute, please contact us. We'll try to resolve things informally first.

Changes to These Terms

We may update these terms from time to time. If we make significant changes, we'll notify you by email at least 30 days before they take effect.

Continued use of mbuzz after changes take effect means you accept the new terms.
